Website use and the Kanu Challenge fundraising and talent-selection campaign

1. Parties and Roles
These Terms of Service (the "Terms") govern access to the canonical Campaign website identified in the Campaign Notice, football-dreamz.com/kanu-challenge, nexargroup.se, each Kanu Challenge page, and every related form, checkout, communication or digital service that links to these Terms (together, the "Website").
Website Provider. Nexar Group AB (publ), Swedish company registration number 556899-2589, at Engelbrektsgatan 9-11, 114 32 Stockholm, Sweden, provides the Website, owns or licenses the Football Dreamz format and supports central campaign administration (the "Website Provider").
Campaign Operator. The sole organiser of the Kanu Challenge, contracting party for Contributions and legal recipient of Campaign funds is Nexar Football Development Ltd, CAC registration no. RC8382579, of No. 2, Garba Ndama Close, Apo Legislative Quarters, Zone E, Abuja, FCT, Nigeria (the "Campaign Operator"). It appears under that name as the recipient at checkout, and its public contact route is info@nexargroup.se. It will hold or maintain the applicable Nigerian permissions or legal mandate, control the designated collection account, administer refunds and remain accountable for Campaign delivery. It is not an unidentified project partner. The Campaign must not accept Contributions until that identity and authority are verified and published consistently.
Nexar Football AB, company registration number 559205-8019, and properly appointed Nigerian football, production or safeguarding partners may provide services to the Campaign Operator. Their involvement does not transfer the Campaign Operator's responsibility to Contributors. Separate participant, guardian, image, medical, travel or football agreements may apply to talent activities.
For general Website use, your agreement is with the Website Provider. When you make a Contribution, your agreement concerning that Contribution is with the Campaign Operator. In these Terms, "Nexar", "we", "us" and "our" mean the relevant entity for the activity described; where both entities jointly make a commitment, each is responsible for its own role and any responsibility imposed by mandatory law.
2. Acceptance, Hierarchy and Scope
By accessing the Website, submitting information, subscribing to communications or making a Contribution, you confirm that you have read and agree to these Terms and the Privacy Policy. If you do not agree, do not use the Website or make a Contribution.
The official rules of the Kanu Challenge are set out in these Terms, including Schedule 1 (together, the "Campaign Rules").
These Terms govern Website visitors and Contributors. They do not replace a participant application, image release, guardian consent, safeguarding agreement, representation agreement, employment agreement, medical consent or professional club contract.
3. Key Definitions
Campaign. the Kanu Challenge fundraising and talent-support initiative described on the Website.
Campaign Notice. the public statement, made in these Terms and on the Website, that identifies the Campaign Operator and states the canonical Campaign host, current dates, territory, Contribution minimum and any payment-method limits, intended use of funds, public-reporting cadence and 'as of' convention, selection process and Talent Benefit.
Contribution. a voluntary fiat payment made to support the Campaign; it is not a purchase price, investment, charitable donation for tax purposes, or payment for a chance to win.
Contributor. an adult who makes or validly authorises a Contribution.
Biggest Supporters. the optional public state/FCT recognition list for Contributors who make a Contribution of NGN 1,000,000 or more and specifically consent to display of their name and optional short message. It is not a prize, benefit, vote or selection advantage, and the Contribution amount is not displayed.
Participant. a football player who separately applies, is validly nominated or is considered through an authorised talent process.
Selected Participant. a Participant chosen by the jury through the published talent criteria, never by random draw or Contribution amount.
Talent Benefit. the non-cash football experience or development opportunity described in the Campaign Rules for a Selected Participant.
4. Eligibility and Authority
To make a Contribution or enter into these Terms, you must:
- be at least 18 years old and have legal capacity to enter into a binding agreement;
- use a fiat payment method that you are authorised to use;
- provide accurate and complete information; and
- comply with applicable sanctions, anti-money-laundering, payment, foreign-exchange, tax and consumer laws.
If you act for an organisation or another adult, you confirm that you have authority to bind that person. We may reject, suspend or reverse a Contribution where we reasonably suspect fraud, unauthorised use, sanctions exposure, abuse or legal non-compliance.
Contributions and newsletter sign-ups are intended for adults. A player under 18 may participate only through the separate process in Section 10 and the Campaign Rules, including parent or guardian involvement where required.
5. Nature of the Campaign and Required Public Messaging
The Kanu Challenge is a fundraising and talent-support campaign intended to help identify and develop young football talent in Nigeria and support related Football Dreamz activities. It is a jury-led talent initiative, not a lottery, raffle, game of chance or contributor prize promotion.
For clarity:
- a Contributor does not enter a prize draw and cannot receive or win cash, goods, shares, travel, match tickets, a meeting with Nwankwo Kanu or any other Talent Benefit merely because they contribute;
- a Contribution does not buy a lottery ticket, raffle entry, vote of greater weight, financial return or improved chance for any Participant;
- Participants apply or are considered through a separate free talent process; making a Contribution is never a condition of participation or selection;
- the Selected Participant is chosen by a qualified jury on published football and safeguarding criteria, without random selection;
- the Campaign is not an offer of securities, investment crowdfunding, lending, a collective investment scheme, a deposit product or financial advice;
- the Campaign Operator is a for-profit company, not a charity or tax-exempt organisation, and Contributions are not tax-deductible unless an authorised receipt expressly states otherwise; and
- a Contribution creates no ownership, voting, repayment, profit-sharing, agency, trust, fiduciary or fund-control rights.
Every landing page, advertisement, social post, checkout and public statement must communicate the same distinction. Public materials must not say or imply that a Contributor can "win a day with Kanu" or receive the Talent Benefit. If the word "win" is used for a player, the material must clearly and prominently state that an eligible Participant, selected by a jury through a separate free talent process, receives the benefit.
6. Core Kanu Challenge Mechanics
Unless the final Campaign Rules state a narrower lawful position, the Campaign works as follows:
- A Contributor selects one of Nigeria's 36 states or the Federal Capital Territory (FCT) as the location they wish to support.
- The Contributor makes a verified fiat Contribution of at least the minimum shown at checkout. The minimum is NGN 2,000 per transaction. The Campaign sets no maximum; the limits of the Contributor's payment method and payment provider apply.
- Each verified Contributor's support indication has equal weight regardless of the amount contributed. A larger Contribution never receives greater judging, voting or selection weight.
- Repeated Contributions by the same Contributor do not increase that Contributor's support weight. We may combine, disregard or de-duplicate artificial, automated or abusive activity.
- State/FCT and overall Contribution totals may be displayed for transparency. They are informational and do not select a Participant or require funds to be spent only in that location.
- A qualified jury makes the final selection based on sporting merit, potential, eligibility, conduct, safeguarding and the criteria published before the closing date. There is no random draw.
- The Talent Benefit belongs only to the Selected Participant and remains subject to identity, age, eligibility, guardian, safeguarding and availability checks and separate acceptance terms.
The Contribution form records the Contributor's own details and selected state/FCT. It also records whether the Contributor freely consents to public display of their name and, for a Contribution of NGN 1,000,000 or more, any optional short public message they submit. Neither the consent nor the message is required, and neither affects the Contribution, support weight, judging or selection. The form must not ask a Contributor to upload a player's photograph, video, identity document, health information or other sensitive personal data. A separate nomination or participant process must comply with Section 10.
7. Contributions and Fiat Payments
The Campaign accepts only the fiat payment methods displayed at checkout. The authorised payment provider is Paystack; the available methods are Card, Bank Transfer, Transfer, USSD and Zap; Contributions are accepted in Nigerian Naira (NGN) only. Any processing fee is added on top of the Contribution, and the fee and the Campaign Operator's legal name, Nexar Football Development Ltd, as recipient are displayed before payment.
By submitting a Contribution, you authorise the payment provider and Campaign Operator to charge the displayed amount and confirm that:
- the payment and Contributor information you provide is accurate;
- the funds are lawful and you are authorised to use the payment method;
- you reviewed the amount, currency, state/FCT selection and any disclosed fee; and
- the payment provider may apply its own terms, privacy notice, identity checks, fraud screening, limits and settlement timetable.
Nexar does not ordinarily receive or store complete card numbers, CVV codes, bank passwords or payment-account credentials. The payment provider processes those details. A Contribution is complete only after the Campaign Operator receives reliable confirmation from the payment provider. A redirect, screenshot or pending status is not proof of completion.
The Campaign payment-processing fee is added on top of the Contribution and is shown before you confirm. The Contribution you select is the amount credited to the Campaign; your payment method is charged the Contribution plus that fee. A bank, card issuer or mobile-money provider may impose separate charges or exchange-rate differences for which Nexar is not responsible, except where mandatory law provides otherwise.
8. Refunds, Reversals and Chargebacks
A Contribution is voluntary and, once successfully processed, is generally final because it may be committed to Campaign planning and delivery. It is not a refundable deposit or a purchase of goods or services. This does not limit mandatory consumer, payment or restitution rights.
We may issue a refund where:
- the payment was duplicated or processed for the wrong amount because of a technical error;
- the payment was unauthorised and supported by reasonable evidence;
- the Campaign is cancelled and the Campaign Rules or applicable law require a refund;
- we cannot legally accept or retain the funds; or
- a refund is otherwise required by mandatory law or expressly promised in the Campaign Rules.
To request review of an error, contact info@nexargroup.se promptly and, where possible, within 14 days after payment. Include the transaction reference, date, amount and reason. Approved refunds are normally returned through the original fiat payment method. Processing charges and exchange-rate differences may be non-refundable unless applicable law requires otherwise.
Before submitting a chargeback for a payment you recognise, please contact us so the issue can be reviewed. We may provide transaction records and these Terms to the payment provider when responding to a disputed charge. This does not restrict a lawful dispute concerning an unauthorised or incorrectly processed payment.
9. Use of Funds and Transparency
The Campaign Operator intends to use net Campaign proceeds for Nigerian youth-football and Football Dreamz activities. Uses may include scouting, talent assessment, coaching, training, equipment, venues, travel, safeguarding, player development, production, local facilities or academies, payment and compliance costs, communications and reasonable Campaign administration.
Any per-state amount, milestone, scouting programme, trial or academy shown on the Website is a planning illustration unless the Campaign Notice expressly labels it as a binding threshold and explains the consequence of reaching it. Actual cost, timing, location and scope depend on net proceeds, approvals, safety, partner performance, budgets and operational conditions. The same explanatory label must appear next to the amount on the Campaign page, not only in these Terms.
Selecting a state/FCT records a preference and may inform programme planning. It does not create a trust, restricted account or legally segregated fund for that location. The Campaign Operator may pool funds and allocate them in good faith across the Nigerian programme to pursue the stated Campaign purpose.
We may publish aggregate Contributor counts, gross or net Contribution totals and state/FCT totals. Published figures update in step with Campaign activity, from immediately after confirmation to within twenty-four hours, and each page displaying a figure labels it "Data as of" with its date and, where material, a time and time zone. Figures may change after payment confirmation, refunds, reversals, fees, reconciliation or currency conversion.
We do not publish a Contributor's email address, telephone number or transaction reference. One non-aggregate recognition feature may appear on a state's page: the "Biggest Supporters" list may display the name and optional message of a Contributor who gave NGN 1,000,000 or more, but only where that Contributor gave specific consent at checkout. The list never shows the Contribution amount. Its order may reflect Contribution size, but that order affects recognition only and has no effect on support weight, judging, Participant selection or fund allocation. A Contributor who does not consent appears anonymously or not at all. Withdrawing consent ends future public display without affecting the Contribution.
If an activity becomes impracticable because of safety, regulation, force majeure, partner failure, insufficient funds or another material circumstance, remaining funds may be redirected only to a closely related Nigerian youth-football, scouting or player-development purpose. A material update will be published where reasonably practicable. Refunds will be provided where promised or legally required.
10. Participant Applications, Nominations, Children and Safeguarding
The Contribution flow and the participant-selection flow are separate. A person does not become a Participant by contributing, and no Participant is required to contribute.
An initial nomination feature, if offered, may request only the minimum information needed to contact the player or guardian, such as the player's name, age band, state, current club or academy, the nominator's identity and relationship, and guardian contact details where appropriate. The nominator must confirm that they are authorised to make the referral and that the information is accurate.
The initial nomination form must not permit uploads of a child's photograph, video, identity document, precise address, health data or other sensitive information. Before obtaining further data, Nexar must contact the player or guardian directly, provide a participant-specific privacy notice, verify age and authority, and obtain the required consent, release or agreement. An unconfirmed nomination must be restricted from public use and deleted within the period stated in the Privacy Policy.
Football Dreamz activities may involve players aged 16 and older. For a Participant under 18, parent or guardian involvement is required wherever applicable law, safeguarding practice or the relevant activity requires it. A child's best interests, safety and privacy take priority over publicity, fundraising or production.
Nexar may reject or stop a nomination, application or activity where authority, age, identity, eligibility or safeguarding cannot be verified, or where continued processing would create an unacceptable risk.
11. Jury Selection and Talent Benefit
The jury applies the criteria published in the Campaign Rules and exercises qualified human judgement. The decision is final except for a material eligibility, conflict-of-interest or process error. Contribution amount, Contributor identity and public totals do not determine the Selected Participant. Judges must disclose and manage relevant conflicts of interest.
The current Campaign concept is a football experience with Nwankwo Kanu in Nigeria for a Selected Participant. The final Campaign Rules must confirm what is included, including the date or scheduling method, venue, travel, accommodation, guardian attendance, insurance, documentation and expenses. Nothing is included unless expressly stated.
The Talent Benefit is personal, non-transferable and has no cash alternative. It may be replaced with a reasonably comparable football-development opportunity if match availability, scheduling, safety, regulation, player eligibility or another circumstance outside reasonable control prevents delivery as described.
Selection does not guarantee a professional trial, club contract, visa, broadcast appearance, representation agreement, income or football career. Separate agreements, medical or safeguarding checks and third-party approvals may be required. A Participant may be disqualified for ineligibility, false information, misconduct, safeguarding risk, prohibited substances, sanctions issues or refusal to complete reasonable verification.
12. Campaign Changes, Suspension and Cancellation
The Campaign Operator may extend, pause, modify or cancel the Campaign where reasonably necessary because of law, regulator or payment-provider requirements, fraud, security, safety, insufficient participation or funds, force majeure, third-party failure, scheduling or a material operational issue. No change may convert a Contributor into a prize entrant, introduce random selection, give greater weight to a larger Contribution or materially misstate the use of funds.
Material changes will be communicated on the Campaign page and, where appropriate, by email. Contributions or support indications that are fraudulent, unlawful, automated, duplicated, manipulated or inconsistent with these Terms may be rejected or removed without affecting valid Contributors.
13. Communications
We may send service communications needed to process a Contribution, issue a receipt, respond to support, provide a material Campaign update, prevent fraud or meet legal obligations. These are not marketing communications.
Newsletters and promotional messages are sent only where permitted by law and in accordance with the Privacy Policy. You can withdraw marketing consent or unsubscribe at any time without affecting receipts, safety notices or other necessary service messages.
14. User Content
If the Website permits you to submit a message, image, nomination, profile, social post or other content ("User Content"), you retain ownership. You grant the relevant Nexar entity a worldwide, non-exclusive, royalty-free licence to host, reproduce, format and display that User Content only as reasonably necessary for the disclosed Website or Campaign purpose, subject to the Privacy Policy and any separate release. A licence to display a Contributor's optional name and message is conditional on that Contributor's consent and ends for future public display when consent is withdrawn.
In the Kanu Challenge Contribution flow, the only User Content a Contributor may submit is an optional public message attached to a Contribution of NGN 1,000,000 or more. The message is limited to 100 characters and may not contain a web address, a line break, invisible or bidirectional-control characters, a composite emoji or prohibited offensive language. A non-compliant message is refused at submission rather than silently edited. We may hide or remove a published name or message where necessary for law, safety, moderation or consent withdrawal; doing so does not affect the Contribution or support weight.
You must have the necessary rights and authority. You must not submit confidential, defamatory, unlawful, infringing, misleading, exploitative or unsafe content. Child or Participant content may be submitted only through the authorised process in Section 10. We may moderate or remove User Content but are not required to monitor every submission.
15. Acceptable Use
You must not:
- break any law, sanctions rule, payment rule, safeguarding obligation or third-party right;
- misrepresent identity, authority, payment status, affiliation or Participant eligibility;
- automate, manipulate, buy, sell or interfere with support indications, totals, the jury process or Campaign data;
- use stolen payment instruments, launder funds, evade limits or submit fraudulent disputes;
- introduce malware, probe security, bypass access controls, scrape at harmful scale or disrupt the Website;
- harass, exploit or endanger a Participant, child, Contributor, judge, partner or staff member; or
- use Nexar, Football Dreamz, Kanu Challenge or third-party names, images or logos in a way that falsely suggests endorsement.
16. Intellectual Property and Publicity Rights
The Website, Football Dreamz format, Kanu Challenge materials, text, design, video, graphics, software, databases and Nexar or Football Dreamz branding are owned by or licensed to Nexar and protected by intellectual-property laws. Subject to these Terms, you receive a limited, revocable, non-transferable licence to access the Website for personal, lawful use.
Names, images, club marks, competition marks and other third-party materials remain the property of their owners. Nwankwo Kanu's name, image and likeness may be used only within the scope of an executed written licence or ambassador agreement. Reference to a club, league, national team, stadium, broadcaster, payment provider or public figure does not imply sponsorship or endorsement unless expressly stated and authorised.
17. Third-Party Services
The Website may integrate authorised payment providers, banks, mobile-money services, social platforms, broadcasters, ticket providers, clubs and other third parties. Their services are governed by their own terms and privacy notices. Nexar does not control their independent acts, outages, fees, content or eligibility decisions, except where Nexar remains responsible under mandatory law or an express Campaign commitment.
18. Privacy and Cookies
The Privacy Policy explains how personal data is processed, including Contributor contact details, state/FCT selection, fiat payment metadata, technical data, nominations, Participant data and marketing preferences. For users in the EEA, analytics, advertising, social-media pixels, third-party media and other non-essential technologies must remain disabled until the user gives prior valid consent; rejecting them must not prevent basic Website access or a Contribution. Strictly necessary security functions and aggregate server-side metrics may operate without cookie consent only where they do not store or access information on the user's device, do not track or single out a person, and are otherwise lawful. Payment providers process payment credentials under their own privacy notices.
19. Disclaimers
To the fullest extent permitted by law, the Website is provided "as is" and "as available". Nexar does not guarantee uninterrupted access, error-free content, a specific fundraising total, a particular number of scouting events, an academy, a broadcast date, a match, a professional contract, commercial success or any outcome not expressly confirmed in the Campaign Rules.
Schedules and football opportunities depend on Participants, venues, federations, clubs, agents, broadcasters, payment providers, government bodies and other third parties. Public figures and events may become unavailable. Forward-looking statements, budgets, audience estimates, milestones and examples are not guarantees.
Nothing on the Website is financial, investment, tax, legal, medical, immigration or professional football advice. Obtain independent advice where appropriate.
20. Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud or fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.
Subject to the paragraph above, Nexar is not liable for indirect, incidental, special or consequential loss, loss of profit, opportunity, goodwill or data, or loss caused by an unauthorised payment method, an independent third-party service, force majeure or a Participant's failure to obtain a club, visa, contract or career outcome.
Subject to mandatory law, the total aggregate liability of the relevant Nexar entity arising from the Website, Campaign or these Terms will not exceed the greater of (a) the total Contributions you validly made to the Campaign during the 12 months before the event giving rise to the claim and (b) SEK 1,000 or its equivalent. This cap does not reduce a refund or other remedy legally required from the Campaign Operator. Nothing in this Section limits any non-excludable right under the Nigerian Federal Competition and Consumer Protection Act or other mandatory consumer law.
21. Indemnity
If you use the Website for business purposes or materially breach these Terms, you will reimburse the relevant Nexar entity for reasonable losses, liabilities and external legal costs directly caused by your fraud, unlawful conduct, infringement, unauthorised User Content or misuse of the Campaign. This clause does not apply to a consumer to the extent it would be unfair or prohibited by mandatory law.
22. Suspension and Termination
We may restrict or terminate access, reject a submission or invalidate manipulated support where reasonably necessary to protect Participants, the Campaign, the Website, payment systems, third parties or legal compliance. Termination does not affect accrued rights, valid payment obligations, privacy rights or provisions that by their nature survive.
23. Changes to These Terms
We may update these Terms for legal, security, operational or service changes. The updated version will state its date and become effective when published, unless a later date is stated. A material change affecting an active Contribution or Campaign will be notified reasonably and will not retroactively remove mandatory rights.
24. Governing Law and Dispute Resolution
A Contribution, the Kanu Challenge, local fund administration and Participant selection are governed by the laws of the Federal Republic of Nigeria and any mandatory law applicable where the Campaign Operator is established. The competent courts of Nigeria have jurisdiction over those matters, subject to any mandatory consumer forum right.
General Website use, Website intellectual property and acts performed solely by Nexar Group AB (publ) are governed by Swedish law, and the courts of Stockholm, Sweden have jurisdiction, subject to mandatory law. If you are a consumer, you may retain the right to bring a claim in your habitual residence and rely on its mandatory protections. Where one dispute concerns both a Contribution and general Website use, the terms and governing law applicable to the Contribution govern the parts of the dispute that concern the Contribution.
Before starting formal proceedings, contact info@nexargroup.se with the issue and requested resolution. We will seek to respond within 30 days. Nothing prevents urgent injunctive relief or a complaint to a competent payment, consumer, data-protection or other regulator.
25. General
If a provision is invalid or unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign your rights without consent. A Nexar entity may assign its rights as part of a genuine group reorganisation, financing, merger or business transfer if mandatory rights are not materially reduced.
These Terms, the Privacy Policy and Campaign Rules are the entire agreement on their subject matter. No third party has enforcement rights unless mandatory law says otherwise. The English version controls over a convenience translation to the extent permitted by law.

Schedule 1 — Mandatory Kanu Challenge Campaign Rules
Schedule 1 §1. Organiser and period
The Campaign Operator identified in Section 1 is the sole organiser and Contribution recipient. The Campaign began on the date specified in the official press release from Nexar Group AB (publ).
Schedule 1 §2. Separate groups
Contributors provide voluntary financial support. Participants enter or are considered through a separate free talent process. A Contributor is not entered for the Talent Benefit, and a Participant does not need to contribute.
Schedule 1 §3. Contributions
Contributors must be at least 18. Fiat payments only. Minimum: NGN 2,000 per transaction. The Campaign sets no maximum; payment-method and provider limits apply. Each verified Contributor's support indication carries equal weight regardless of amount; repeat Contributions do not add weight.
Schedule 1 §4. State/FCT support and Biggest Supporters
A Contributor may select one Nigerian state or the FCT. Totals are informational, may guide outreach and planning, and do not select a Participant or create a restricted fund. Each public figure carries a "Data as of" date and updates in step with Campaign activity, from immediately after confirmation to within twenty-four hours. The "Biggest Supporters" list may show only a consenting Contributor's name and optional message for a Contribution of NGN 1,000,000 or more, never the amount; display order has no effect on judging or selection.
Schedule 1 §5. Participant eligibility
There is no registration or nomination route for Participants: players are identified through Football Dreamz's own scouting and selections.
Schedule 1 §6. Initial nominations
Only minimum referral data may be collected. No child image, video, identity document, precise address, health data or sensitive information may be uploaded in the initial flow. Direct player or guardian notice and permission are required before further processing or publicity.
Schedule 1 §7. Judging
Selections are made by a jury exercising human football judgement. Contribution amount and Contributor identity are excluded. There is no random draw.
Schedule 1 §8. Verification and announcement
Selection is conditional on identity, age, eligibility and safeguarding checks and separate acceptance terms. Public announcement requires the appropriate player/guardian notice and permission. The Campaign does not contact Contributors individually about selection; questions go to info@nexargroup.se.
